A Snapshot of Streamlined Purchase Activity by U.S. State

Greetings!

Prompt Payments Anyone?

Right before the end of FY11, the Administration issued memo "M-11-32" that effectively told agencies to speed up payment activities as it related to small government contractors. Can anyone tell me how they did?

A few days later (after having a chance to digest the contents of the memo) I published a blog entitled "Accelerated Payments Are Nice Mr. President, But..." where I referred to the initiative as a nice gesture but one that was short of the mark needed to make a substantive difference. I also added that a way to make more of a difference would be to incorporate small government subcontractors into the mix since their numbers are presumably much larger than small businesses working under direct contract.

Imagine my surprise when they actually did it.

Yup! A new memo with the title "Providing Prompt Payment to Small Business Subcontractors" was just issued with language that does exactly what I suggested last year, except for one not so small problem, small contractors need to have to have work in order to get paid for it, right?

ANC Numbers Down - Bittersweet, But Still Sweet

There should not be too many folks reading this who don't know my thoughts on the debacle created by the late U.S. Senator Ted Stevens and the ridiculous government contracting latitudes imparted to a tiny segment of the government contracting community. I'm not saying benefits were not and are not due to Alaskan Natives, but certainly they are not as deserving as our men and women who wear the uniform of our Nation's Armed Forces, leave their loved one's behind to protect our freedoms, and come home (those lucky enough) with physical and mental scars that will never heal.

It seems time's are changing and it's about time.
Sarah Chacko over at Federal Times reports the number of contracts awarded to Alaskan Native Corporations has apparently declined, sharply.

She states in her article that agencies awarded ANCs $4.4 billion in contracts in FY11, $2.5 billion of it through sole-source contracts valued at $20 million or more. For FY12, ANCs have only seen $1.8 billion to date, with only $587 million in sole source contracts ($20 million or more) so far.

If the delta of those awarded dollars have stayed in the small business community, I'm happy, but if they have somehow escaped and been tacked onto contracts with the usual suspects, then not so much.

I guess we'll find out in the coming months.

If quick turn federal agency buys valued between $3,000 and $150,000 per transaction happening in this state are of interest to you, here are a few things you should know.

YTD simplified acquisition purchases exceed $745 million dollars
DoD, GSA, State, DHS and Justice are the top five spenders when it comes to simplified acquisitions YTD (where Virginia is the place of performance).
Small business awards (YTD) under this streamlined purchase method total $328,834,298
Payments via the GSA SmartPay/SmartPay2 Purchase Card were $11.6 million dollars YTD and represented purchases in 268 different NAICS Codes.

Before you do, you might want a bottle of antacid before you take in the headline we've got for you, which is:

I Think I Missed Again! Uh-Huh!

If you haven't heard, Government gave itself a grade of "B" for it's efforts in meeting (or not!) the small business goals tied to federal procurement. As my friend Mark Amtower mentions during his latest installment of "Amtower Off Center" on Federal News Radio today, there must have been a very steep curve in effect when this grade was given. This is not intended to slight the many hard working folks in government who try to balance mission and small business participation, just a statement about how we small businesses perceive our "worth" to more than a few in government and the "other than small" part of this community.

But this failing grade is only part of the story (They didn't meet the goal, right? Then they failed!). I managed to scratch down a few thoughts in my blog that resulted in my linking Uncle Sam to singer Phil Collins. Why? Because they both have a tune called "I Missed Again." Would you believe an agency official used the term headwinds to describe why the Government is falling further away from the goal?

Remember what this is all about (not just the fireworks and great chow on the grill) and more important, send up a few kind thoughts for our men and women (and their families) who are away from home serving in defense of our Nation.

Payments via the GSA SmartPay/SmartPay2 Purchase Card were $2.6 million dollars YTD and represented purchases in 46 different NAICS Codes.

I got a call the other day from a guy I know who has been in this business for a while, as an employee. He decided to start his own company and called me for a gut check about the registration process. "Why does it cost $599 to get registered as a government contractor?" he asked.

If you do business with federal agencies in California, here are a few things you should know.

DoD, VA, DHS and Justice and HHS are the top five spenders when it comes to simplified acquisitions in FY12 (YTD).
Small business awards under this streamlined purchase method total $48,560,305
Two NAICS Codes account for the top ten purchases paid for by purchase card with a combined value just over $1 million.
Payments via the GSA SmartPay/SmartPay2 Purchase Card were $5.7 million dollars YTD and represented purchases that referenced 62 different NAICS Codes.

Going off-topic this week:
'Footloose' and high school graduations in SC and OH

As the father of a two year old, education is something at the top of my list of things to consider. So when I saw articles this weekend that talked about parents in South Carolina being arrested in one instance, or a kid having their diploma withheld until they or their parents completed 20 hours of community service for committing the crime of 'disorderly conduct' which is known as (in the remaining sane states) parents cheering when their child's name is called during a high school graduation.

Really? Is your school system doing that dang good that your priority list is topped with 'ensure an orderly graduation assembly' and arrest anyone that cheers?

I wonder if John Lithgow can reprise his role as Rev. Shaw Moore and offer some healing for these real-life "Bomont's"

I've got a busy week ahead of me that includes kicking off our new Business Over Breakfast in Reston, VA, hosting a Federal Contractors Roundtable in DC, providing an overview of federal agency fiscal spending via webinar and speaking at the small business procurement conference in Fairfax hosted by Congressman Jim Moran. I've been asked to discuss "Growing Your Small Business with Simplified Acquisitions." and will provide a substantive overview of the streamlined acquisition method that continues to close the gap on GSA Schedule spending (only a delta of $23 billion in FY11 versus a delta $32 billion in FY09).

And those are just the "formal" events I'm involved with this week. I've got another half dozen meetings with sponsors, new members and planning for new programs to help our members find, qualify and win federal contracts and subcontracts.

Never let it be said I'm not a proponent of the GSA Federal Supply Schedule. Trust me, if I wasn't, my friend Courtney Fairchild (Global Services) would be first in line to have my head. The "schedule" continues to be a useful tool for Government and often a "ticket to the dance" for many contractors, based on their offering and with whom they currently (or intend) do business.

On Monday, June 4th at 2:00PM ET, the SAP Task Force will present a review of the Department of Justice, to discuss what it buys, how much it spends and where it spends streamlined purchase dollars.

To date, DOJ has executed nearly 30,000 contract actions for goods and services via simplified acquisition procedures, totaling over $416 million dollars.

Based on current spending, the best states for contractors to be in for receiving Air Force SAP dollars are Virginia, Maryland, California, Texas and Florida.

Air Force Flying High Via Simplified Acquisitions

On Monday, May 14th at 2:00PM ET, the SAP Task Force will present a review of the U.S. Air Force, to discuss what it buys, how much it spends and where it spends its streamlined purchase dollars.

To date, the Air Force as a whole has executed nearly 5,000 contract actions for goods and services via simplified acquisition procedures, totaling over $173 million dollars.

The National Security Agency Small Business Set-aside program (NSETS) is an important agency initiative that enables NSA to competitively acquire agency requirements for business, engineering, information technology, operations support, and training services from teams of highly qualified small businesses. In preparation of the next generation of this program (NSETS 3.0) our Small Business Intelligence Community and Cyber Working Group (SBINT/CYBER) will host a half-day session entitled 'NSETS Industry Review' on May 10th in Columbia, MD.

NOTE: Participation in the NSETS Industry Review is limited to U.S. citizens representing U.S. owned/controlled companies doing business as government contractors/subcontractors. All registrations are subject to approval for this event. Questions? Contact us at events@theasbc.org.

Mobility, Micropurchases and Simplified Acquisitions. Perfect Storm of Opportunity?

So far, DHS/CBP has executed more than 1,000 simplified acquisition actions valued over $63 million dollars.

Based on this spending, CBP has done business in 37 U.S. states and territories using 181 different NAICS Codes.

Folks, you are not going to believe this one. It's a good thing and I'm still trying to recover from the shock to my system. A solid idea has been birthed on the Hill that does not involve merging agencies, inventing the next NAICS Code system, redefining what a small business is or penalizing agencies ten percent of their procurement dollars.

Federal Agencies Are Off Last Year's Pace, But There is Hope.

We usually have good news to report as it relates to Simplified Acquisitions, and hopefully we'll be able to return to that with next week's installment.

In the spirit of giving you the "lay of the land" for streamline purchase spending, here we go!

This time last fiscal year (October 1, 2010 to March 25, 2011) there were 316,000 contract actions processed by federal agencies. For FY2012, we only seen 249,000 actions processed, a decrease of 67,000.

For everyone out there tuned into this soap opera, it helped make sense of information that is normally tediously confusing.

Agency streamlined purchase spending exceeds $4 billion dollars for FY12

Small businesses have seen roughly half of this, but hey, the year is still young!

As of this post, the agencies leading the spending charge are:

U.S. Mint
U.S. Army
Veterans Affairs
State Department
GSA/FAS

By the way, if you are located in the National Capital Region, know that three-quarters of a billion dollars has already been spent where DC, MD and VA were the place of performance. This has been accomplished via just over 24,000 contract actions. That's an average of $30K per transaction.

Not too shabby for purchases that are simplified.

Did we mention the current debate underway where SBA claims all Simplified Acquisitions are to be set-aside for small business? Yep, they notified OFPP earlier this year that agencies were not complying with the FAR.

Did we also mention Simplified Acquisitions accounted for over $16 billion in agency spending during FY2011?

Greetings!

It is with great sadness I announce the passing of our advisor and friend, Bob"Steakum" Salisbury, who died March 8th after a long battle with cancer. Bob will likely be best remembered as the founder of the Washington Breakfast Club which he transitioned to The American Small Business Coalition several years ago when he decided to spend more time developing patents for solutions that support our nation's homeland security, specifically at ports. Bob also served in the U.S. Navy where he is remembered for making great contributions to the security of defense-based communications.

Bob was also co-founder of a breakfast meeting still held at the Silver Diner in McLean, VA that started nearly twenty years ago. Today, it is known as our Business Over Breakfast program that channels the spirit of the original meeting started by Jack, Ted and Bob.

Yesterday I had the honor of fulfilling his family's request by saying a few words at his memorial.

His kindness and friendship will be sorely missed.

Three recent industry articles captured on the GovConChannel seem to signal the start of reviews and potential changes to how agency procurements are done under the simplified acquisition procedures and via reverse auctions.

Lack of FAR Test Program Makes Capitol Hill and Agencies, Well...Testy.

The budget didn't pass until April last fiscal year, making for an interesting and compressed spending term. Even so, federal agencies managed to spend $4 billion dollars more in FY11 than in FY10 using streamlined purchase rules.

One of the ways they did this was through the use of an obscure FAR exception known as the Commercial Item Test Program.

In FY11, agencies spent nearly $2 billion dollars via 3,475 contract actions under this particular exception.

Authority for this program expired on January 1, 2012 but agencies still managed to process over 600 contract actions totaling $314,127,734.84 from 10/01/11 to 1/01/12 (according to FPDS-NG). DoD, DHS and VA led that particular charge.

These purchases already amount to more than $450 million dollars in awards for FY2012, with Veterans Affairsleading the way with $84 million dollars in contract actions already processed.

So far, small businesses have realized $250 million dollars of these contracts.

It's that time of the season. Small Government Contractors should not believe the hype!

The political season is heating up which means the increased 'posturing' from all sides will occur in ever-increasing levels of nauseating frequency. Think about it. We're seeing more action from the Hill now, than at any other time in recent history (except when Congress is voting on its own pay raises) with the bulk of the gibberish targeted at garnering the attention (and securing the votes) of, wait for it, small businesses!

Under the Radar!

Contract actions between $3,000 and $25,000 represent the first tier of purchasing under the simplified acquisition procedures (SAP) and fall below the normal posting (synopsis) criteria for FedBizOpps.

While this may not be as impressive as winning a large omnibus contract, the time from problem-to-solution is much shorter than for normal buys. In FY11, purchases in this range represented more than $2 billion dollars spent with half being awarded to small business.

In fact, one company doing business with the VA has already racked up more than $3 million dollars in business this fiscal year with more than three hundred purchases in this range.

Idaho reigns supreme!

No, this is not a chamber of commerce ad for the potato state, but recognition of the more than $420 million dollars spent via streamlined purchase methods this fiscal year (already) with a place of performance in Idaho. More than fifty organizations (including the State of Idaho) have taken at least one of the more than one-thousand contract actions issued by U.S. Mint, Veterans Affairs, OPM, Bureau of Land Management and the Forest Service.

Small government contractor? Here's a not-so-hypothetical situation.

Let's say as of this week, your company is one with average revenues or employees that are roughly half of the current small business size standards. That positioning will likely undergo significant change on March 12, 2012 when 37 size standards are increased, allowing more than 8,000 "other than small businesses" a rebirth in the government contracting assistance programs for small businesses.

What's this mean for you and the other companies facing this new obstacle?

On hearing this news, one of our members summed it up this way:

The SBA effectively just screwed my company and every other small business that should have been able to compete this year as our direct competitors graduated out of the small business category. I reckon in 5 years they will increase the $14M to $21M or $30M - the SBA just put me and a whole lot of other truly "small" businesses out of business.
